Terms of Service

These Terms of Service (the "Terms") set out the conditions for using "kittobako" (the "Service") provided by Simple System Inc. ("we", "us"). By using the Service, you are deemed to have agreed to these Terms. This is an English translation for convenience; in the event of any discrepancy, the Japanese version prevails.

Article 1 (Definitions)

1. "Service" means the service that generates 3D models with AI from images you upload, splits them into parts and provides an on-screen assembly experience, together with related features such as official kits we provide.
2. "User" means an individual who agrees to these Terms and uses the Service.
3. "Submitted Content" means images and any other data you upload or enter into the Service.
4. "Generated Works" means the 3D models, kits, images, etc. that the Service generates from Submitted Content.

Article 2 (Account)

1. The Service uses a login link sent to your email address (passwordless authentication) to create and use an account.
2. You manage your registered email address and login links at your own responsibility and must not share them with third parties.
3. Actions taken through your account are deemed to be your own actions.

Article 3 (Fees, subscription, cancellation)

1. The Service has free features and paid one-time purchases and subscriptions (Premium). Fees, payment methods and delivery timing follow the Notation based on the Act on Specified Commercial Transactions.
2. Subscriptions renew automatically unless cancelled and are charged on each renewal date.
3. You may cancel by the prescribed method by the day before the next renewal date, after which billing stops. No pro-rata or other refunds are made for mid-term cancellation.
4. Payments are processed through Stripe. We do not retain card information.

Article 4 (Key rules for Photo-to-Kit and Submitted Content)

1. Photos, illustrations, 3D data, etc. shot or created by others, to which you have no rights.
2. Characters from anime, games, manga or films; product or brand logos or designs; or anything else infringing a third party's copyright, trademark or design rights.
3. Anyone else's likeness, name or publicity rights without proper rights or consent.
4. Anything unlawful or against public order and morals, or that is obscene, violent or discriminatory.

5. Generated Works may be used for your personal use and for non-commercial sharing (posting to the Service's "Everyone's Works", featuring on SNS, etc.). Sale and commercial use are not permitted. Works posted to "Everyone's Works" are displayed to other users and visitors within the Service (you may request removal at any time).
6. We send Submitted Content to an overseas AI provider (Google LLC) for conversion into toy-style images (3D generation and blockization are processed on our own servers). Details are in the Privacy Policy. You use this feature upon agreeing to this.
7. We may delete Submitted Content or Generated Works suspected of violating this Article without prior notice, and may suspend the account. We respond in the same way to reports from rights holders.
8. About applying to and being featured in "Everyone's Works". If you choose to apply, the work (generated image) is displayed within the Service only after review by AI and, where necessary, a human review by us. It is not public before passing review. Works with military subjects always undergo human review. We may make edits necessary for display (cropping, resizing, etc.). You represent and warrant that you hold the rights or consent needed to feature any people, third-party products or characters appearing in the work. You may request removal or suspension of display at any time.
   * Featuring on official SNS (Instagram / Facebook) is done only for works with the separate "SNS consent (sns-2)" obtained at posting time, after our staff individually checks the final image and text, as ordinary posts on our official accounts (no unreviewed automatic reposting). Posts are public worldwide, and no nickname or other personal information is shown in the post text. Paid advertising and boosting are not included in this consent. See the Privacy Policy for details.

1. When publishing or sharing Generated Works, indicate that they are AI-generated.
2. Do not use Generated Works to train or improve other AI models.
3. The Photo-to-Kit feature is available only to persons aged 18 or older under the terms of the generative AI used.

Article 5 (Intellectual property)

1. Intellectual property rights in all content we provide, including the Service and official kits, belong to us or the rightful owners.
2. Rights in Submitted Content are reserved to you. However, you grant us a license to use Submitted Content and Generated Works to the extent necessary to provide and improve the Service (generation, storage, display, troubleshooting, etc.). In addition, for works posted to "Everyone's Works", you grant a license to use and edit them to the extent necessary for display and featuring within the Service. Featuring on official SNS (Instagram / Facebook) is licensed only where you have given the separate, optional consent (SNS consent sns-2) at posting time, within the scope of that consent. Such featuring is published worldwide as an ordinary post on our official accounts, and for publication you grant Meta the license needed to display and distribute the work under Meta's terms (processing may occur on servers outside your country, e.g. the U.S.). No nickname or other personal information is shown in the post text. Paid advertising and boosting are not included in this consent; a separate consent will be obtained if used. You may withdraw consent at any time; after withdrawal we make no new posts (however, complete deletion of anything already posted, distributed, cached or shared before withdrawal cannot be guaranteed).

Article 6 (Prohibited acts)

You must not do the following.

1. Acts violating laws or these Terms, or infringing third-party rights.
2. Acts obstructing operation of the Service, unauthorized access, reverse engineering, excessive automated access, etc.
3. Unauthorized use or transfer of an account, or circumventing fees or usage limits.
4. Military or weapons-related use. Using the Service or Generated Works for military, warfare or intelligence purposes, or for the design, development, manufacture, assembly, testing, training, aiming/target identification, operation, modification, maintenance/repair of weapons, firearms, ammunition, explosives or their parts, or otherwise to support such activities, and allowing third parties to use them for such purposes. The Service is provided solely for toy, hobby and display purposes. Images whose main subject is firearms, ammunition or weapon parts, or that contain technical depictions such as dimensioned drawings, exploded views or internal structures, are declined. Works depicting real military vehicles, military aircraft or warships may in future be offered only as deformed toy representations, but generation is currently suspended until legal review is complete.
5. Other acts that we reasonably deem inappropriate.

Article 7 (Changes, suspension, termination of the Service)

We may change the content of the Service, or suspend or terminate its provision, with prior notice to users (or subsequent notice in emergencies). We bear responsibility for damages arising to users to the extent set out in these Terms.

Article 8 (Disclaimer / limitation of liability)

1. The Service includes automated AI processing and does not guarantee the quality, accuracy or split results of Generated Works. Good results may not be obtained depending on the input image.
2. Except in cases of our willful misconduct or gross negligence, we are not liable for damages arising to users in connection with providing the Service. Where we are liable for damages, the total is capped at the amount of fees you actually paid us in the immediately preceding 12 months (except in cases of our willful misconduct or gross negligence).
3. The Service is provided "as is" and we do not warrant fitness for a particular purpose, uninterrupted operation or freedom from error.

Article 9 (Exclusion of anti-social forces)

You represent and warrant that you are not, and are not involved with, anti-social forces. If a violation is found, we may immediately suspend use.

Article 10 (Changes to these Terms)

We may change these Terms as necessary. We announce material changes within the Service; if you continue using the Service after the announcement, you are deemed to have agreed to the changed Terms.

Article 11 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. In the event of a dispute concerning the Service, the Yamaguchi District Court shall be the court of exclusive agreed jurisdiction for the first instance.
